These Terms of Service ("Terms") govern your use of Social Poster, a social media scheduling and posting tool provided by Top Flight Health ("we," "our," or "us"). By connecting a social media account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Access
Social Poster is an internal tool provided for authorized Top Flight Health team members. You may use the Service only if you have been granted access and are at least 18 years old or have legal authority to bind the connected social media account.
2. Connecting Third-Party Accounts
- You may connect social media accounts (e.g., TikTok) to the Service through each platform's authorization process.
- You are responsible for ensuring you have the right to authorize posting to the connected account.
- You may disconnect an account at any time within the Service or by revoking access from the platform's settings.
- We may suspend or terminate access to a connected account if we believe it violates these Terms or applicable platform policies.
3. Your Content
- You retain ownership of all content you create, upload, or schedule through Social Poster.
- You grant us a limited license to store, process, and publish your content to the connected social media platforms you select, at the times you schedule.
- You are solely responsible for the content you schedule and publish. You represent that your content does not violate any law or third-party right.
- We may refuse to publish content that we believe violates these Terms or applicable platform policies, but we have no obligation to review content before publishing.
4. Acceptable Use
You agree not to use Social Poster to:
- Publish content that is unlawful, defamatory, harassing, or infringes on intellectual property rights
- Post spam, unsolicited promotional material, or automated engagement that violates platform rules
- Impersonate another person or entity
- Circumvent rate limits, restrictions, or security measures of any social media platform
- Use the Service in a manner that violates the terms of service of any connected platform, including TikTok's Developer Terms and Community Guidelines
5. Third-Party Platforms
- Social Poster integrates with third-party platforms such as TikTok. We do not control these platforms and are not responsible for their actions, policies, or availability.
- You must comply with the terms of service, community guidelines, and developer policies of each platform you connect.
- Platforms may revoke API access, rate-limit requests, or change their policies at any time, which may affect the Service's ability to publish to that platform.
- We are not liable for actions taken by a platform against your account or content as a result of posts made through the Service.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that posts will be published successfully, on time, or without error. We are not responsible for platform outages, API changes, or content rejections by third-party platforms.
7. Limitation of Liability
To the maximum extent permitted by law, Top Flight Health shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, account penalties from third-party platforms, or failure to publish content on schedule.
8. Indemnification
You agree to indemnify and hold Top Flight Health harmless from any claims, damages, or expenses arising from content you publish through the Service or your violation of these Terms or any third-party platform's policies.
9. Termination
You may stop using the Service at any time by disconnecting all connected accounts. We may terminate or restrict your access to the Service at any time, with or without cause or notice. Upon termination, we will cease publishing to your connected accounts, and any scheduled posts that have not yet been published will be cancelled.
10. Changes to These Terms
We may update these Terms from time to time. We will notify authorized users of significant changes. The "Last updated" date above reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Top Flight Health operates, without regard to conflict-of-law principles.
